PUBLIC PROCUREMENT REMEDIES SYSTEMS

Organized by the State Commission for Supervision of the Public Procurement Procedure and SIGMA, official sponsor: President of the Republic of Croatia Mr. Stjepan Mesić, international conference was held in Dubrovnik, hotel Ariston - Importanne Resort, from May 24-25 2007.

The topics chosen for the Conference were foreseen as highly relevant for the exchange of experience in the field of public procurement procedures focusing on legal protection. International experts addressed the participants with the following issues:

public procurement review and remedies systems
in the European union - report by SIGMA
Further development of regulation of review procedures in the EU,
Remedies in national legislations - experience of EU Countries,
Legal nature of review procedures,
Judicial protection of rights from tendering procedures,
Basic principle of competition and other public interests in tendering procedures,
Remedies form perspective of private sector
Etc.

Mrs. Višnja Tafra, Mr. Mesić's spokeswoman, opened the international conference, and was joined by Mr. Branko Hrvatin, president of the Supreme Court of the Republic of Croatia, Mr. Piotr Nils Gorecki from SIGMA and Mr. Goran Matešić, head of the State Commission.

Main theme of the conference was the one of dr. Martin Trybus, who presented work of SIGMA, which covered detailed display of all systems of the legal protection in public procurement of the European countries, so that one could have reached many useful information at one spot.

A number of interesting topics were covered during the two day conference, and we will mention just a few. Dr. Josip Kregar analyzed impact of the transparency as basis of the legal protection, president of the High Commercial court mr. Srđan Šimac talked about damages in public procurement, dr. Gabriele Herlemann presented Germany's experiences about legal protection of the public procurement, dr. Tina Eržen-CEO of MBA School of Management Bled- talked about the legal protection's quality impact on the market of public procurements, Tomaž Vesel carried out a line of interesting observations about private sector's interests in legal protection in public procurement procedures, Marija Cvrlje- deputy head of the State Commission- talked about right of action in the Republic of Croatia, dr. Peter Braun presented observations on the legal protection system in public procurement from the lawyer's perspective, Goran Matešić talked about some noted dilemmas in public procurement systems as well as some future trends. There were many other lecturers at the conference, who participated at the workshops, and who considerably contributed to the quality of the whole conference with their observations, discussions and quality of their displays. The conference was closed by Mr. Bertrand Carsin- Director Public Procurement Policy Directorate Internal Market and Services DG, with a theme on future development of legal standardization of legal protection system in public procurement in the EU.

During the conference, on May 24 2007, dinner was organized for all the conference participants in the beautiful Rector's palace, with the sounds of the "Concertina" orchestra, and a courteous host, deputy major of Dubrovnik city Mr. Vedran Jelavić, which stayed in beautiful memory and was an excellent linkage of the quality of the work at the conference and the beauties of Dubrovnik city.

Big interest of the participants and pleasure of the lecturers because of the joint work on such a project, are the main reasons why we have already made first necessary meetings toward organization of a sequel conference in September of 2008 and we hope that you will join us then as well.
